General Terms & Conditions

Scope of Application

These General Terms and Conditions (GTC) apply to all contracts for travel services between Global Cruise Adventures GmbH (hereinafter "Operator") and the customer (hereinafter "Traveler"). They supplement the statutory provisions of §§ 651a - y BGB (German Civil Code) and Articles 250 to 253 of the EGBGB (Introductory Act to the German Civil Code).

Deviating conditions of the Traveler are not recognized unless the Operator expressly agrees to their validity in writing.

Conclusion of the Package Travel Contract

2.1. With the registration, the Customer bindingly offers the Operator the conclusion of a package travel contract. The registration can be made in writing, orally, by telephone, or electronically (email, online form).

2.2. The contract is concluded upon receipt of the travel confirmation (declaration of acceptance) by the Operator. Upon or immediately after conclusion of the contract, the Operator will provide the Customer with a travel confirmation on a durable medium.

2.3. If the content of the travel confirmation differs from the content of the registration, this constitutes a new offer by the Operator, to which he is bound for a period of 10 days.

Payment

3.1. After receipt of the written travel confirmation and issuance of the security certificate (Sicherungsschein), a deposit of 20% of the travel price is due. The deposit will be credited against the travel price.

3.2. The final payment is due 30 days before the start of the journey, provided the security certificate has been handed over and the journey can no longer be canceled for the reasons stated in section 5.

3.3. If due payments are not made or not made in full, the Operator reserves the right to withdraw from the contract after issuing a reminder with a deadline and to demand compensation in accordance with §5.

Service Changes

4.1. Changes to essential travel services (e.g., route changes due to weather conditions) that become necessary after conclusion of the contract and were not brought about by the Operator in bad faith are permitted, provided the changes are not significant and do not affect the overall nature of the trip.

4.2. The ship's captain bears sole responsibility for the safety of passengers and crew. Decisions on route changes due to force majeure, ice conditions, or political unrest are at his discretion and do not justify claims for price reduction.

Withdrawal by the Customer

The Customer may withdraw from the package travel contract at any time before the start of the journey. The withdrawal must be declared in writing to the Operator. If the Customer withdraws from the travel contract, the Operator may demand reasonable compensation.

We strongly recommend purchasing travel cancellation insurance.

Limitation of Liability

6.1. The Operator's contractual liability for damages that do not result from injury to life, body, or health is limited to three times the travel price, provided that a damage to the Traveler was caused neither intentionally nor by gross negligence.

6.2. The Operator is not liable for service disruptions, personal injury, and property damage in connection with services that are merely mediated as third-party services (e.g., local excursions that are not part of the main package), if these services are expressly identified as third-party services in the travel description.

Passport, Visa, and Health Regulations

7.1. The Operator will inform nationals of an EU member state about provisions of passport, visa, and health regulations before conclusion of the contract, as well as any changes to them before the start of the journey.

7.2. The Traveler is responsible for obtaining and carrying the officially required travel documents, any necessary vaccinations, and for complying with customs and foreign exchange regulations. Disadvantages arising from non-compliance with these regulations, e.g., the payment of cancellation fees, shall be borne by the Traveler.

Choice of Law and Jurisdiction

8.1. The contractual relationship between the Customer and the Operator shall be governed exclusively by German law.

8.2. The Customer may only sue the Operator at its registered office in Hamburg. For lawsuits filed by the Operator against the Customer, the Customer's place of residence is decisive.
